Terms of Service
Effective date: April 2, 2026
These Terms of Service ("Terms") govern your use of ProofAnchor ("the Service"), operated by Fulcrum Enterprises LLC ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. What ProofAnchor Does
ProofAnchor computes a SHA-256 cryptographic hash of files you provide and anchors that hash to the Polygon blockchain. This creates a timestamped, immutable record proving that a specific file existed in your possession at a specific point in time.
ProofAnchor proves temporal priority of possession — that you had a file at a given time. It does not prove authorship, ownership, or copyright. The link between a proof and your identity is based on your ProofAnchor account (email address), not on-chain identity verification.
2. Accounts
You must provide a valid email address to create an account. You are responsible for maintaining the security of your account. One person or entity per account. You must be at least 18 years old to use the Service.
3. Your Files and Privacy
ProofAnchor never uploads, stores, or accesses your files. File hashing occurs in your browser. Only the cryptographic hash is transmitted to our servers and written to the blockchain. You retain full ownership and control of your files at all times.
4. Blockchain Records
Once a hash is anchored to the Polygon blockchain, it is permanent and cannot be modified, deleted, or reversed by anyone — including us. You understand and accept the immutable nature of blockchain records before anchoring a proof.
5. Plans and Payments
ProofAnchor offers free and paid subscription plans. Paid plans are billed monthly through Stripe. Prices and plan features are listed on our Pricing page.
Each plan includes a monthly proof allotment. Unused proofs do not roll over. Upgrade your plan for a higher limit.
6. Refunds
Because blockchain transactions are irreversible and incur real on-chain costs, proofs that have been successfully anchored cannot be refunded. If blockchain anchoring fails for any reason, the failed proof does not count against your plan allotment and no charge is incurred for that proof.
If you cancel your subscription, you retain access through the end of your current billing period. Unused proofs do not roll over.
7. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose or to anchor hashes of illegal content, including but not limited to child sexual abuse material (CSAM), stolen data, or materials that violate applicable law
- Attempt to reverse-engineer, disrupt, or compromise the Service
- Create proofs with the intent to fabricate false evidence or mislead others
- Abuse the API or automated access in a way that degrades the Service for others
Violation of this section may result in immediate account termination without notice. We may cooperate with law enforcement agencies investigating illegal use of the Service and may disclose account information as required by law.
8. Limitation of Liability
ProofAnchor is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that blockchain anchoring will succeed for every proof.
To the maximum extent permitted by law, Fulcrum Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Disclaimer and No Reliance
ProofAnchor is not a legal service, law firm, or substitute for legal counsel. Blockchain proofs may support your position in a dispute, but we make no guarantees about their admissibility, weight, or acceptance in any legal proceeding, court, or administrative body.
You expressly acknowledge that you should not rely on ProofAnchor proofs as your sole evidence in any legal matter. ProofAnchor proves temporal priority of possession only — it does not constitute legal proof of authorship, ownership, copyright, or any other legal right. Any decision to use a ProofAnchor proof in legal proceedings is made at your own risk and discretion. Consult a qualified attorney for legal advice.
10. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.
11. Dispute Resolution and Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration shall take place in Florida. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Fulcrum Enterprises LLC.
Small claims exception:Either party may bring an individual action in small claims court in lieu of arbitration, provided the claim falls within the court's jurisdictional limits.
12. Intellectual Property
You retain all rights to your files and any content you create. ProofAnchor does not claim ownership of your files, hashes, or proof records associated with your account.
Fulcrum Enterprises LLC owns all rights to the ProofAnchor platform, including its software, design, branding, and documentation. Blockchain records are public by nature and are not owned by any party.
13. Indemnification
You agree to indemnify, defend, and hold harmless Fulcrum Enterprises LLC, its officers, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.
14. Force Majeure
Fulcrum Enterprises LLC shall not be liable for any failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including but not limited to: blockchain network outages or congestion, Polygon network failures, third-party service disruptions (Stripe, Brevo, Cloudflare), natural disasters, acts of government, internet outages, or cyberattacks.
15. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Continued use after changes take effect constitutes acceptance.
